Glasgow's media has been buzzing today with stories about landlords withholding deposits from former tenants.
A number of reasons are being quoted, one being that the landlord no longer has the cash to return to the tenants. Others quote being given spurious reasons for deductions from their deposit such as exaggerated repair costs. The Citizens Advice Bureau has been called upon to help distressed tenants.
What the problems appear to show is a - desperate, in some cases - need for an independent body to help landlords and tenants deal with each other more fairly. And while rules have existed for years to protect tenants' deposits, there has always been a lack of enforcement of these rules.
In general, good landlords have always played by the rules and so-called 'rogue' landlords found ways to get around them. Hopefully, the Tenancy Deposit Scheme (TDS) will make the latter easier to spot.
TDS will help in several ways: it's up to the landlord to prove to his or her tenants that the deposit has been placed within 30 working days of the lease commencing. If the landlord fails to do that, tenants can take them to court with a good chance of being awarded three times the deposit value.
TDS regulations can also be extremely helpful at the end of a lease when there is a dispute about how much of the deposit is returned to the tenant.
How can you protect yourself? Look at more than the property. Even if you really like the flat, ask yourself whether your landlord appears to have proper procedures in place: have you been offered a detailed check-in and check-out together with your landlord or their agent? Was there an inventory available, listing all items in the flat? Is it easy to reach your landlord? And do they have the correct paperwork available to show to you, such as their landlord registration, energy performance certificates or gas safety certificates?

We've had a busy few weeks here at the Cullen Property office since launching our first lot of Edinburgh student pads at the Heriott-Watt accommodation fair in February. The team has been out showing flats since then, and they became even busier earlier this month, following the launch of our second lot of student properties at the EUSA accommodation fair.
Both fairs were very well attended, and with most students entering their second year of university having to leave accommodation halls, demand is high. In fact, within five days of launching the second half of student flats, 50% have been rented for the new academic year - well ahead of our target.
Some of the highest quality properties in the most desirable areas saw dozens of students queue to view the flats in question and we received up to five applications for the same flat. We let them on a first come, first served basis.

- So how many of you are there? Decide on the number of friends you're planning to move in with before viewing a flat. If there are five bedrooms, five of you need to sign on the dotted line, so you will all need to be present and available when you go to finalise the paperwork for the flat.
- How much for gas & electricity? Any advert should show an energy efficiency rating which gives you a good idea of the gas & electricity costs the flat will incur, A being the most and H the least efficient. Landlords who aren't upfront about this kind of information are likely to have something to hide - always bad news.
- Fees, anyone? So-called 'agency fees' or 'referencing fees' are now illegal and landlords still trying to charge them are quite simply bad news.
- Checking in and checking out? You should be given a thorough check-in and check-out where you go through the property's inventory together with your lettings agent. It's the easiest way to highlight any faults that relate to previous tenants and ensure you receive your full deposit back when you move out.
- Where will your deposit be kept? As of 2012, landlords must place deposits with one of three government-approved tenancy deposit schemes. The landlord has to comply to this rule within 30 working days of the start of your tenancy and send a certificate to confirm it's been done. If your landlord doesn't comply, you can sue for three times the deposit!
- Read the small print! Make sure all of you read the full tenancy agreement before you sign it. You'll be bound to it for the next twelve months and it's important to know your and the landlord's rights.

Heading home for the holidays or looking to spend time somewhere warmer? Here are some handy tips to ensure your flat and your belongings stay safe over Christmas and New Year.
- Don't turn off your boiler to prevent frozen and burst pipes. To save energy and keep your heating bills reasonable, simply set it to come on for an hour in the morning and the evening. This also helps to stop dampness developing.
- Take your valuables such as jewellery, laptops and cameras with you or store them in a safe.
- Fully lock your flat door on both mortice and yale locks.
- Ensure your windows are fully closed with any latches engaged. Where possible, also lock your windows.
- Tell your landlord if you are away for more than a few days, giving them a chance to keep an eye on the property.
- Consider putting one or more lights on a timer switch to make the flat appear inhabited over the holidays.
- Disconnect any electric plugs which won't be used.
- Empty the fridge of any food that will be mouldy by the time you return in 2013.

To many students, savings are something to be thought about later, after they finish university. And while financing your daily life through student loans, allowances and pay from part-time jobs seems hard enough, that later is now.
A new survey by HSBC suggests that millions of households in the UK have so little savings they could hardly survive until the weekend if they had to rely on them. On the other hand, information from Barclays Bank confirms that more than 50% of students hold a savings account of some sort.
Whether these are left over from students' childhood days when parents, grandparents and other family members topped them up on birthdays and at Christmas to create a little nest egg or the product of a conscious decision before going to university, most of these savings accounts aren't topped up enough.
The recommended 'salary cushion', according to HSBC, is the equivalent of three monthly salaries. However, the bank's study found that 19% of households have no savings at all and 12% have less than £250. Even for student households, these are scary figures.
So what should you do? Start saving, even if it's as little as £3 per week, the equivalent of a pint! Here's a handy guide to various savings products, but don't forget to check your own bank's options first. Being a customner already can help give you access to better deals and, you never know, you may just be able to work up to a little nest egg yourself.

Consequently, the number of people reading comparisons right increases to nearly nine out of ten as soon as price plans are presented in a simpler fashion.

While we were all enjoying yesterday's sunshine, 'our' trees in Teaghlach Wood in Perthshire would have breathed a sigh of relief when today turned out to be a little cloudier.
Believe it or not, when the whole country was complaining about the never-ending rain over the past couple of weeks, our trees couldn't have been happier. Trees4Scotland's Angus Crabbie explains: "Trees really do love rain as it helps them grow, especially when they're young."
And while we were rejoicing about finally dusting off the barbecue again, forests are looking forward to the next rainy day to continue to develop.
There is a more serious side to this story as well: While trees need rain to grow, reforestation in general is one way to prevent landslides etc as the roots help avoid soil erosion - a natural contribution to our flood defences.

Last week, we introduced our partnership with Trees4Scotland, aiming to neutralise the carbon footprint of all 320+ properties managed by us.
We've done our figures and here are some of them: initially, we'll be investing over £1,600 on behalf of three clients which will buy us 232 trees. Those trees will also offset the carbon footprint of our office and the company vehicles.
The properties are rated depending on their size: a 2 bed flat with kitchen, bathroom and living room would need 5 trees whereas a 5 bed flat with 2 bathrooms and a combined living kitchen would need 9 trees in total.
So far, so good! Over the next couple of weeks, the team will be hands-on at Teaghlach Wood, planting trees and we're delighted to be joined by a couple of clients based locally.

We're joining Trees4Scotland with the ambitious goal to offset the carbon footprint of all of our managed flats.
We're well aware that every business does have an impact on the environment and needs to work on minimising it. Trees4Scotland seemed the perfect partner: their initiative to restore native Scottish woodlands is a perfect way for us to do our share.
For each property, Angus Crabbie of Trees4Scotland will help calculate the amount of trees we need to plant to offset its carbon footprint.
We will be starting with three clients initially, but all of our landlord clients will be invited to join us with their properties and go carbon neutral. For decades, if graduates were asked what they were looking to do in relation to their living arangements after leaving university, a majority was looking to get their feet on the property ladder and buy as soon as they could.
Now, with asking prices rising again and mortgages still hard to get for many young professionals, renting seems to become a longer-term solution. At the same time, landlords are looking to increase their portfolios and the UK rental market in general has had a strong start to 2012.
What does it mean for you? Whilst it may take a few more years to own your own home there will be a good selection of high quality rental properties available. With more landlords expanding their portfolios, too, tenants will have more choice and, naturally, the quality of rental properties will increase at the same tim, making renting a good longer-term option.

During the week of the Diamond Jubilee, statistics wizards at Lloyds TSB have looked at what's happened to the private rental market over the past sixty years. Whilst their findings are specifically for England, it's a similar picture in Scotland showing that not only do 41% of households now have a second toilet - but also reminding us that renting a home was very popular in the 1950s. The number of home owners grew in the 1970s and 1980s, but now renting's on the up once again. Surprisingly, though, there's still 1% of properties that have no basic water supply!

The Scottish government is today embarking on a review of the private lettings market with a view to creating a more long-term culture, both for tenancies and for property investors and landlords. Germany has been cited as an example. Today Cullen Property attended an Accommodation Fair hosted by the Accommodation Services at the University, and what a day!
It was superbly organised with a huge number of students attending with a number of different stalls to visit.
The stalls ranged from storage companies to letting agents, giving students various aspects of managing their next move.
A big thank you to the accommodation services for organising such a great day, we will look forward to next year's!
Cullen will be getting themselves organised for their Student Property 2012 Launch Event to take place this coming Wednesday.

Whether you are staying in your rental property over the Festive period or heading off to visit family and friends, it is important to make sure you have made preparations to keep your property safe over the winter months.
The biggest threat being the weather, which can cause all sorts of problems such as burst pipes etc.
We, at Cullen, have put together a list of tips to make sure your property is well protected from the weather and also from a security point of view:
- Keep your heating on for two hours twice a day to keep the pipes warm, and also to reduce the problem of dampness in your property. (Especially if you are leaving the property for some time).
- Put a light or two on a timer so it looks like there is someone staying in the property over the time you are away from the property.
- Make sure all windows and doors are properly closed and locked. This includes closing all internal doors, as this helps to retain heat.
- Use all available locks on flat doors as these hinder thieves.
- Ask any friends that are staying in Edinburgh if they can pop in to check the property and collect post from the back of the door to reduce the risk of a fire hazard.
- Do not leave appliances on standby and unplug all plugs. (Especially items such as phone chargers, hair straighteners, toastie machines etc).
- Do not leave valuables in clear sight of windows or doors, take them with you if possible. Otherwise store them in a hidden place.
If you are at all concerned about leaving your property over the winter months please do not hesitate to contact us and we will be happy to assist you.

One of the most reoccuring issues we see in our properties is mould and dampness, and this usually occurs in bathrooms.
The cause of mould and dampness is condensation and there are four reasons why condensation occurs:
1) There is alot of moisture,
2) There is not enough ventilation,
3) There is not enough insulation,
4) There is not enough heating.
In which case, to make sure that your home is not plagued by condensation you can do the following:
- keep rooms ventilated frequently, by opening windows or switching on extractor fans,
- make sure the rooms are heated frequently,
- dry laundry outside or in a ventilated room,
- cover cooking pans to keep moisture levels down.

For the student tenants that have moved over the Summer, hopefully you have now settled down and enjoying your new property.
Now is the time to have made sure that you have contacted the City of Edinburgh Council to make them aware you are students and therefore exempt from paying Council Tax.
We at Cullen would have contacted the Council at the start of your lease to let them know you have moved in, however it is up you as tenants to contact the Council if you are exempt from paying .
This is due to Data Protection and you will be sent a form (one per property) to complete by everyone living in the property. You then need to send this form back and once you have received a Certificate of Exemption, you are no longer liable for the Council Tax.
If you have not carried out this process, you will receive bills from the Council and will do so until you have your Certificate of Exemption.

1. The freedom to move from property to property. This is obviously much harder to do if you are tied into a mortgage and then you also have the hassle of trying sell the property; where as with renting you have a choice as to whether you stay or leave at the end of the lease. Also, the lease length can usually be negotiated after the first 6 months, so instead of having to commit to a further 6 or 12 months, you can extend for a couple of months giving flexibility.
2. When things go wrong it is up to the Landlord to sort the problem. This will not apply if the tenant has been at fault, however if for example a faulty boiler breaks down, it is the responsibility of the Landlord to repair. In which case, no hefty bills to the Tenant for general maintenance issues.
The way people are living is changing and we are moving away from the 'need' to own your own home to the ease of renting, as the whole point of renting is to make the property your home.

- Ghost Tours - Mary Kings Close is a popular one, however there are a number of ghost tours that take you around Edinburgh's Old Town.
- Camera Obscura - a very fun day out with illusions that will make your head spin!
- Carlton Hill - great for a walk with views across to Fife.
- Arthurs Seat & Salisbury Crags - another great walking area with outstanding views across Edinburgh.
- Dynamic Earth - after a brisk walk up Arthurs Seat, head down to Dynamic Earth where you will learn about our amazing planet.

The Scotsman today published an article on the UK being voted the worst country to live in Europe. Well we can think of 10 reasons why the UK if the best place to live in:
1. The history - the UK has an ancient and interesting history with all the battles between Scotland and England, with the castles to prove it!
2. The countryside - from the Highlands to the rolling English countryside, there is nothing like the Autumn when all the leaves start to change colour to show the contrast between the red and auburns against the green grass.
3. The architecture - there is an abundance of beautiful architecture in the UK from the historic buildings in Edinburgh to the thatched cottages in England.
4. The weather - there are some advantages to our four seasons! For skiers and snowboarders the ski slopes in Scotland are a winter haven and for sun worshipers, the beaches in Cornwall could give the French Riviera a run for it's money.
5. The Universities - the UK boasts a number of the world's best Universities.
6. The Royal Family - the Royals are a fascinating family and you can not help but be intrigued with their traditions and way of life.
7. The NHS - often the topic of criticism, however we are incredibly lucky to have the NHS where anyone can walk into any hospital in the UK and receive free healthcare.
8. Sport - you can do just about anything in the UK from surfing in Devon to hillwalking in the Highlands, as well as Scotland being the home of golf (St. Andrew's), as well as being having the oldest golf course (Musselburgh) in the world.

They can face as many hurdles and barriers to getting a home as someone looking to buy. Yes the amount of money varies; however for anyone that has just left school or university to find a job in any city in the UK, will find that whether it be an additional £500 or £5000 to pay upfront before getting the keys to a home, will be just as difficult.
As a renter, you need to have enough money to pay the deposit and first month's rent upfront, and for those that are looking for employment tend to have to pay more as an additional security for the landlord.
The other issue facing renters these days is securing a property in the first place. There has always been a great amount of competition in the rental market so getting to view a property in the first place can be a difficult task
Obviously the good news about renting is should anything go wrong in the property such as a boiler breakdown, it is down to the landlord to make sure it is repaired in a reasonable time-frame and they pay for it.
Also there are not the constraints of buying a property and for some the moving from property to property on a 6 monthly basis is all the fun!

Lock your door with all available locks - this may seem obvious, however many people just leave their property with just the yale locked. The majority of our properties have a yale and mortice lock on the flat door, and it is the the mortice lock which is a much safer lock as it is harder to break into a property with this lock on. Using all available locks should be done both when you are out of the property and at night time.
Close all windows - again this is something that should be done while you are out of the property and at night time.
Keep all expensive gadgets etc out of plain view - especially if you are in a ground floor property as these could easily be seen by passers by.
Put lamps on a timer - as the nights are drawing in at this time of year you may want to put lamps on a timer to give the impression that someone is in the property. This would be a good idea to do if you are going to be leaving the property over a weekend or longer.
Make sure you have the right type of insurance for your contents in place in case the worst does happen.

Insurance is usually at the bottom of the priority list when people are moving, as often the setting up of the broadband account, making sure the car permits are in place, and the check in appointment has been confirmed etc, tend to come first.
However, it is important to make sure that you have the right insurance cover in place and on time.
The building itself and the Landlord's own contents are insured by the Landlord, meaning it is just your own contents that you will need to insure.
Once you start looking into all the different policies, you will see that the insurance companies cater for the individual; for example if you are musically minded, the company will offer insurance to cover the replacement or repair of musical instruments if yours is damaged or stolen.
Another issue to bear in mind is the Accidental Damage and Negligence option that you can choose to include in your contents insurance. This does increase the amount of money that you will pay for your insurance, however insures your belongings as well as the Landlord's if you inadvertantly damage any of their contents and/or the property itself.
For example, if a tap is left on and the property is flooded, the damage could include floorings, decoration and contents (Landlord and/or Tenant's). The costs of replacing or repairing any of these issues will be covered by the insurance if this option is chosen at the time of purchasing the tenant's contents insurance.
Choosing the Accidental Damage and Negligence option is often a far cheaper alternative to the possible costs if anything were to happen as an accident in the property, and we highly recommend it!

The building itself and the Landlord's own contents are insured by the Landlord, meaning it is just your own contents that you will need to insure.
Once you start looking into all the different policies, you will see that the insurance companies cater for the individual; for example if you are musically minded, the company will offer insurance to cover the replacement or repair of musical instruments if yours is damaged or stolen.
Another issue to bear in mind is the Accidental Damage and Negligence option that you can choose to include in your contents insurance. This does increase the amount of money that you will pay for your insurance, however insures your belongings as well as the Landlord's if you inadvertantly damage any of their contents and/or the property itself.
For example, if a tap is left on and the property is flooded, the damage could include floorings, decoration and contents (Landlord and/or Tenant's). The costs of replacing or repairing any of these issues will be covered by the insurance if this option is chosen at the time of purchasing the tenant's contents insurance.
Choosing the Accidental Damage and Negligence option is often a far cheaper alternative to the possible costs if anything were to happen as an accident in the property, and we highly recommend it!

If you have just moved into one of our properties you will find that you will be inundated with mail for previous tenants.
We do advise our tenants to put a redirection service in place, however this can sometimes be missed with all that is happening when people move.
When you receive any mail that is not in your name please forward this on to our office and we can send it on to the right people.
It is illegal to open someone else's mail, so we want to make sure our tenants are doing the right thing!
Mail that is marked to The Occupier is OK for tenants to open, however we would recommend that if you are not sure whether the mail is relevant to you please pass it on to our office.

According to a story in the Metro this morning, this is a question that some students are being asked by organised crime gangs. Apparently the criminals are targetting students, especially foreign nationals, and asking them to pay fraudulent cheques for large sums of money into their accounts. The student is promised that they will receive some of the cash for their involvement and are being told that they won't get caught even though it is a criminal act.However, it appears that when things go wrong, the criminals will then expect the student to pay them their larger share of the money even if the cheque doesn't clear.
We would strongly advise all of our tenants to be aware of this scam and contact Lothian and Borders Police if they are approached by these gangs.

I carried out a viewing in the south of the city earlier today and the prospective tenant could have been forgiven for thinking he'd been tele-transported to the Swiss Alps! The view from the livingroom was stunnng as the sun was glistening on the snow covered Pentland Hills in the distance.

After the success of the University Accommodation Fairs, and working on the necessary documents and leases, we will soon be emailing our new tenants to say that your lease is ready. You will then be asked to phone our office to arrange an appointment to go through all the lease documentation.
We use a Short Assured Lease, which is approved by the City of Edinburgh Council. We also. All Guarantors will be receiving the lease by email prior to the tenants signing, and all Cullen staff are able to answer any questions regarding the lease.
Insurance: Another point discussed at the lease signing is the tenant's contents insurance; all tenants are advised to have contents insurance for their own belongings, as the landlord only insures the building and their own contents (white goods and furniture). It is worthwhile checking whether parents' own contents insurance already covers their son or daughter's contents in another property, as it often does.

The new brand: For those of you who may not yet have noticed, Cullen Property has re-branded and celebrated with a launch party. We now have a swish new logo and website, as well as a newly branded office and company vehicles. You don't need to worry about us having moved as we are still at 30 Rutland Square - we are just easier to find with the more prominent logo plaque on the door!
